It is the policy of Invest Hong Kong to observe the Data Protection Principles to the full extent in relation to the personal data it holds.

Practice

The Departmental Secretary has been appointed the Departmental Personal Data Controlling Officer to ensure observation of the applicable duties and obligations under the Ordinance at the departmental level, and to oversee and co-ordinate necessary actions to ensure the collection and keeping of personal data comply with the data protection principles.

Standard forms are available at Invest Hong Kong’s Head Office on Level 15, One Pacific Place, 88 Queensway, Hong Kong for raising access/ correction requests of personal data held by Invest Hong Kong. Written requests made in other forms would also be accepted.

Types of Personal Data Held

Invest Hong Kong holds the following two broad categories of personal data -

Personnel records of all employees which include the personal and family particulars, education, qualifications, employment history, appraisal reports, promotion board assessments, records of conduct and discipline, etc. and recruitment and appointment data on applicants for appointment to grades under the control of the Director-General of Investment Promotion.

Customer records which include personal information such as name, office and post, contact telephone number, address, etc. of individuals who have dealings with Invest Hong Kong under the control of the Director-General of Investment Promotion.

Main Purposes for Keeping Personal Data

Personnel records of employees are kept for purposes related to appointment, promotion, transfer, training, discipline, etc. and personal data on applicants are kept for appointment purpose.

Customer records are kept for contact, accounting and legal purposes.

The Right of Subject Access

Under Section 18 and 22 of the Personal Data (Privacy) Ordinance, an individual, or an authorised relevant person on behalf of an individual, is entitled to make a data access request to –

(a) ascertain from Invest Hong Kong whether it holds personal data of which he or she is the data subject; and

(b) if Invest Hong Kong holds such data, to be supplied with a copy of such data upon payment of copying and necessary charges.

The Right of Data Correction

Following the supply by Invest Hong Kong a copy of personal data in compliance with a data access request, an individual is entitled to ask for correction of the personal data concerned if he or she considers that the data are inaccurate. This is to be done by means of a data correction request to Invest Hong Kong. Such a request may also be made by a properly authorised relevant person.
